BENEFICIAL INTEREST NATURE AND HOLDERS IN TRUSTS NOT LIMITTED BY COMMON LAW COUNTRIES

Abstract
There is an overview of the key characteristic of the trust concept as a unique institution of common law countries, conducted in this article. Trust concept has three key participants (settlor, trustee and beneficiary) and is set up in relation to certain property (trust-fund). Particular attention is paid to beneficial interest as special ground for capacity (“locus standi”) and as one of the key elements of the trust concept.
