CHEATING AS A SIGN OF THE OBJECTIVE SIDE OF BRINGING OBVIOUSLY INNOCENT TO CRIMINAL LIABILITY

Abstract
The article is devoted to the fraud as the sign of the objective side of obviously innocent criminal liability. It also con- siders other obligatory signs of the objective side of the crime, provided for in Art. 372 of the Criminal Code of Ukraine; the essence of the socially heavenly act and the form in which it may be committed is determined there, the character of deception is given as the method of crime committing. On the basis of it the significance of these signs for the solution of theoretical issues and the practice of using Art. 372 of the Criminal Code of Ukraine are revealed.
