CLASSIFICATION OF HUMAN TRAFFIC UNDER THE CONDITIONS OF OPERATIVE INVESTIGATIVE MEASURES

Abstract

The article analyzes the judicial practice regarding the qualification of human traffic under the conditions of operative investigative measures. This analysis allowed to reveal an ambiguous approach of investigative and judicial authorities in this matter: almost every second such case is treated as an criminal attempt. On the basis of the regulations of the criminal legal science on the classification of formally defined crimes, as well as the recommendations of the Supreme Court of the Russian Federation regarding the classification of other formally defined crimes (articles 174, 174.1, 204, 204.1, 204.2, part 1 of article 228.1, articles 290, 291, 291.1, 291.2 of the Criminal Code of the Russian Federation), detected during confirmation operative investigative measures, the author concludes about the only correct way of classification of human traffic under the conditions of operative investigative measures as a completed crime.
