CLASSIFICATION OF INFORMATION AND LEGAL RELATIONS IN BORDER SPHERE

Abstract

The article is devoted to the study of the classification of information and legal relations within the framework of the functioning of the border agency. The up to date state and legal relations are characterized by progressive openness and transparency in their activities due to the development of civil society and European integration. Activities of bodies of the state border guard service became significantly open, especially after transformation from a military formation into a special law enforcement agency (2003) and the further active introduction of European standards of border guarding into the activities. The development of the information component of the state border protection system of Ukraine and the expansion of information exchange framework are provided by the Development Strategy of the State Border Guard Service of Ukraine. The distribution of various types of information relating to both internal and external activities of the border authority results into the expansion of the classification criteria for the information and legal relations. The classification of information and legal relations has already been the content of scientific works, including the researches of similar relations with the participation of certain bodies of state power, but the classification of information and legal relations in the border sphere was not considered separately, which increases the relevance of their research. The aim of the research is to determine criteria for the classification of information and legal relations in the border sphere on the basis of analysis of existing approaches to the classification of information and legal relations. The article determines that the classification of information and legal relations in the border sphere is a systematic arrangement of information and legal relations, which consist of separate subgroups combined by common features and properties characteristic of the sphere of the state border protection. The study emphasizes the lack of legislative consolidation and unity of scientific understanding concerning the classification of information and legal relations. Considering the fact and taking into account the peculiarities of information and legal relations, the following criteria for the classification of information and legal relations in the border sphere are formulated: depending on the direction of activity; according to state and legal interests; by the order of providing (receiving) of data; by sources of data about information and legal relations; by availability; according to the form of fixing, preservation and dissemination of information and legal relations; by content (orientation); by the directions of reporting about the activities of the SBGS; depending on the subject structure; by the territory; by the circle of subjects. Taking into account the dynamism, versatility, rapid development, and dependence of the researched relations on the objective conditions of the state border protection, it can be assumed that the defined criteria of classification are not comprehensive. The proposed classification of information and legal relations in the border sphere can be used for theoretical and legal substantiation of similar relations of other state authorities, and the expansion of classification criteria become the subject of further scientific research.
