CONFLICT OF LAWS ISSUES OF PRE-CONTRACTUAL LIABILITY

Abstract
The determination of the law applicable to the pre-contractual liability faced with a conflict of legal qualification of this kind of responsibility, which gets different legal characteristics – contract, tort, quasi-contractual – in different countries. The possible way to overcome these drawbacks is the unification of conflict of laws regulation. In an effort to put the end to the debate on the qualifications of pre-contractual liability, the European legislator has decided the issue through the prism of tort characteristics, providing a special conflict of laws rule on culpa in contrahendo in the Rome II Regulation.
