ESSENTIAL TERMS OF A LOAN AGREEMENT FOR CIVIL LEGISLATION OF UKRAINE

Abstract
The article explores the state of legal regulation of the essential conditions of the loan agreement in the civil legislation of Ukraine. It is proved that due to the absence in Chapter 71 of the Civil Code of Ukraine of the list of essential terms of the loan agreement in the science of civil law, there is no unity of views in this matter. The author considers terms of the subject of the agreement, the interest rate, the type of interest rate, the procedure for paying interest, as well as the procedure for calculating the interest rate, the maximum amount of the interest rate increase, the repayment term of the loan, as well as all those conditions, concerning which an agreement must be reached at the request of one of the parties. Based on the conducted research, the author proposes the introduction of appropriate changes to Chapter 71 of the Civil Code of Ukraine.
