CONSTITUTIONAL AND LEGAL STATUS OF A CHILD IN UKRAINE: CONCEPTION AND PECULIARITIES

Abstract
The article is devoted to the research of the constitutional and legal status of a child as constitutional regulation’s object, as well as a special member of the Ukrainian society. Having analysed and compared the relevant international legal treaties, ratified by Ukraine, and the national normative legal acts, as well as having studied the theoretical experience and conclusions of the academic community on this issue, the author of this paper proposes her own version for the definition of the conception on the constitutional and legal status of a child. In the paper the author emphasizes, that the peculiarities of the constitutional and legal status of a child are expressed in their adherence to the legal status of a person and a citizen together with consideration of the age limitations, established by the law. The author is giving argumentation to her thesis that it is inacceptable to identify the following categories: “legal status” and “constitutional and legal status”. The author comes to the conclusion, that constitutional and legal status of a child can be realized only with a condition of its statement in the legislation and procurement by the state. It is underlined in the article, that the institute of children rights in Ukraine has not been fully formed till now, it is at the stage of development and requires further scientific research and legislative consolidation.
