COUNCILLOR LIMITATIONS ARISING DUE TO ARTICLE 24E SECTION 5 OF THE DISTRICT SELF-GOVERNMENT ACT

Abstract

One of the anticorruption limitations of a councillor is an interdiction to take extra jobs or to accept gifts which could undermine electors’ trust in councillor’s carrying out a mandate in accordance with an oath that has been taken. Formulating the content of suitable regulations the legislator used vague expressions, i.e. “extra jobs”, “which could undermine trust” and did not determine straight sanctions for the infringement of the enacted interdiction. On that account these limitations raise numerous doubts in practice. This is why the author has made an attempt to analyse suitable regulations in order to clarify what extra jobs and gifts can be at issue in practice, who is entitled to investigate whether the regulations have been infringed or not and whether any sanctions can be applied in such a case, and what sanctions are to be applied if any.<br/><br/>
