DEFINITION AND NATURE OF A TREATY AS A LEGAL PHENOMENON ІN GENERAL AND AS A SOURCE OF LAW IN PARTICULAR

Abstract
The article is devoted to the study of a treaty as a category of science of theory of state and law. Definition and legal nature of a treaty as a universal instrument of regulation of social relations and as a general legal category, sources (form) of law, are analyzed. The paper presents scientific approaches to general theoretical characteristic and definition of a treaty. It is noted that for constructing a meaningful definition of a legal category of a treaty, it is necessary to isolate its semantic “core”, which would reflect its nature. Scientific views on the essence of a treaty as a legal phenomenon and its attribution to sources of law are presented. Solitary a normative legal treaty is considered as a special legal structure.
