Abstract
The aim of this article is to explore the role of an expert in mediation. An expert is most obviously needed in mediation when parties realize they need additional information to evaluate settlement. The author presents two different ways to obtain a professional opinion: private expert’s opinion and expert witness opinion in judicial proceedings. No party could call an expert witness without the court’s permission. Deciding whether to grant permission, the court will consider whether there is cogent need for expert evidence, how helpful the evidence will be and whether these benefits justify the cost involved.
