ECONOMIC - PROCEDURAL PECULIARITIES OF DISPOSITION OF PROPERTY THE DEBTOR AS STAGE OF THE PROCEEDINGS BANKRUPTCY AND STAGES

Abstract
Studied economic - procedural peculiarities of disposition of property of the debtor as the stage of the proceedings in the bankruptcy case. Analyzed procedural stages covered by stage of proceedings on bankruptcy (preparatory, preliminary, main and final), which in turn directed to the objectives and tasks of the procedure through a unified system of proceedings the parties and participants in the Commercial Court. Formulated stages of creating the internal structure of each stage, which is the most rational form find its implementing rules of substantive law. The need for research features disposal of property of the debtor as the stage of the proceedings in the bankruptcy case and its stages due to the fact that, in the scientific and legal literature stage of the proceedings and its stages on the example of the procedure disposition of property in the bankruptcy deeply studied and proceedings bankruptcy, in terms of sequence performed actions and measures in view of the opinion of various scholars are heterogeneous. In science issues stages of the proceedings in the bankruptcy case is devoted to fundamental work I. A. Party, S. V. Vasiliev, V. N. Horshenov, V. I. Lightman, S. V. Minkovskyy, T. Stepanov, V. I. Tertyshnikov, M. I. Stefan, K. S. Yudelson and others.
