EXCLUSION OF FREE TRADE PARTNERS FROM SAFEGUARD MEASURES

Abstract
The paper examines exclusion of products originating in parties to free trade agreements from safeguard measures and compliance of this exclusion with provisions of WTO agreements. It also analyses a practical application of relevent provisions by Ukraine and concludes that Ukraine should take WTO Appellate Body’s interpretations into account in conducting safeguard investigations.
