FEATURES CONTRACTUAL REGULATION OF PROPERTY RELATIONS OF SPOUSES MARRIAGE CONTRACT

Abstract
The article deals with the features of contractual regulation of property relations of spouses. The author proposes to edit article 93 of the Family Code of Ukraine by disclosure of the contents of property relations of spouses, noting that a marriage contract can regulate property relations of spouses – relations between spouses concerning their property. It’s proved that animals on which the mode of a thing is spread may be the subject of a marriage contract as opposed to the enterprise as a unified property complex, which is due to the fact that it is a real estate can not be included in the terms of the marriage contract as an object of property relations of spouses. It is concluded that civil legislation admits the possibility of concluding a marriage contract concerning certain parts of an enterprise as a unified property complex, but not concerning the whole enterprise, which is a difficult thing. The only condition for concluding such a marriage contract is that the parts of the enterprise as a property complex should be used for its intended purpose – for entrepreneurial activity.
