FEATURES OF DEFINITION OF THE SUBJECT OF CRIMINAL VIOLATION OF THE RULES OF WEAPON HANDLING AND ALSO WITH SUBSTANCES AND SUBJECTS WHICH MAKE THE INCREASED DANGER TO ENVIRONMENT (ART. 414 OF THE CRIMINAL CODE OF UKRAINE)

Abstract
The article deals with the problems and features of the inventions of the special subject of criminal violation of the rules of weapon handling and also with substances and subjects which make the increased danger to environment, establishes the circle of persons who can be prosecuted for the commission of this crime, different approaches and the most widespread viewpoints on his study are presented here. The factors that influence the correct definition of the subject of the crime provided for in the art. 414 of the Criminal Code of Ukraine are given, reveals its role. Indicates the effect of signs of the special subject on the characteristics of the public danger of a crime as well as on the proper qualification of the act. Also, to determine the subject of a crime provided for in art. 414 of the Criminal Code of Ukraine, refers to the meaning of time and circumstances of the commission of a crime, as well as the “special age” of a person. The following concepts are covered: “serviceman”, “military liability serviceman”, “reservist”. Their brief characteristics are given.
