Forensic psychological preconditions for the formation of a system for counteraction to investigator or prosecutor, who committing crimes against justice

Abstract

The article is devoted to the research of forensic psychological preconditions for the formation of a system of counteraction to crimes against justice, committed by the investigator or prosecutor. For this idea, the author tried to studied the behavior and psychological signs of investigator and prosecutor, who in their work allow crimes against justice. Professional and procedural status of investigator and prosecutor, the use of legal knowledge in criminal proceedings allow them to abuse their rights, reaching criminal result. In pursuit of their criminal intention, the investigator and the prosecutor are influenced by emotions and feelings that can be transformed into motives for committing a crime: revenge on the suspect through a summary of the indictment, which corresponds or does not correspond to the offender, a pity for the victim or his/her relatives, a pity for the suspect and his/her relatives, manifestation of principle or unscrupulousness through careerism, motive of corruption and others. Setting the manifestation of such motives investigator or prosecutor may indicate crimes against justice that will serve to the counteraction to criminal acts at a different stages of its committing.
