GENESIS OF LEGAL LIABILITY IN ROMAN LAW

Abstract
This studies covers the formation and development of the institution of legal liability in Roman law, which is the source of the formation of legal systems of the Romano-Germanic type. The author investigates the legal provision of the institution of legal liability at various stages of the development of Roman law: 1) archaic law (753 – 367 years BC); 2) pre-classical (pretorial) period (367 – 17 years BC); 3) the classical period (17 BC – 212 years BC); 4) the post-classical period (212 – 476 years AD); 5) the Justinian period (527 – 565 years AD), and in particular, the sources of law that contained the rules of the institution of legal liability during these periods, as well as the place and significance of the institution of legal liability in Roman law for the contemporary Romano-Germanic type of legal systems .
