HISTORICAL-LEGAL ASPECT OF THE FORMATION AND DEVELOPMENT OF THE 'RIGHT TO APPLY TO COURT' THROUGH THE SCOPE OF THE ROMAN PRIVATE LAW

Abstract
In the article there have been considered the main historical stages of the development of the judicial form of protection in the time of the establishment and development of the Roman state, which has enabled the separate knowledge of the right to apply to the court as the main component of the institution of protection. In the article there have been analyzed separate normative provisions of the legal monuments of the Roman state, which reflect the origins of the formation of the right to apply to the court. There have been observed different peculiarities of the reflection of the right to apply to the court and its dynamic development during the transformation of the judicial protection. There have been examined its constituent parts, which collectively constitute a unified system of the right to apply to the court. There has also been determined the time of the emergence of the right to apply to a court and the moment of its actual application at each stage of its development.
