Implementation of public control in the field of public procurement as a form of realization of citizens’ constitutional rights

Abstract

The article deals with issues of organizational and legal provision of participation of citizens and public organizations in combating corruption in the field of public procurement in Ukraine as a necessary condition for the implementation of the constitutional rights of citizens to information and their participation in the management of public affairs. According to the Constitution of Ukraine, Ukrainian citizens are guaranteed the right to information and their participation in the administration of state affairs, ensuring the openness of the formation and implementation of a stable, understandable economic and social policy, obtaining reliable information about the activities of state authorities and local self-government bodies. The efforts of law enforcement agencies alone to combat corruption in public procurement are not enough. The maximum reduction of this negative manifestation is possible only with the merger of efforts of law enforcement bodies and public organizations, as well as the corresponding regulatory and legal framework of the said sphere. The basis for the development of such a mechanism could be the adoption of the Law of Ukraine "On Civil (Civic) Control", which would allow to create not only legal but also actual preconditions for activating and consolidating public efforts in counteracting corruption phenomena in the field of public procurement in Ukraine and the establishment of interaction between actors of such control and law enforcement bodies. Based on the foregoing, one can conclude that the further development of interaction between public organizations, individuals and law enforcement agencies in the exercise of control functions in the field of public procurement will contribute to the detection of illegal actions by representatives of the state customer, which in turn will affect the reduction of the level of abuses in the said sphere, as well as rational use of public funds.
