INSURANCE OF ATTORNEYS’ ACTIVITY IN UKRAINE: TO BE OR NOT TO BE?

Abstract
The article is devoted to the analysis of legal institute of attorneys’ activity insurance in Ukraine. The authors come to the following conclusion: the insurance of attorney’s professional activity is important both for attorneys and for their clients because it protects the clients from a risk of receiving the services of bad quality, and the attorneys – from unmeasurable expenditures in case of professional mistakes’ execution. Taking into the consideration the foreign experience and euro-integrative intentions of our country, the authors support the idea of step-by-step input of the obligation for practicing in Ukraine attorneys at law to make an insurance of their professional activity. It is underlined in the article that the similar obligation takes it place both in the Code of Conduct for Lawyers in the European Union, and in the European Court of Human Rights judgments, which have to be executed as sources of law also in Ukraine. While implementing the institute of attorneys’ activity insurance it is advised to use as an example the order and the rules of conducting obligatory insurance of civil legal liability of private notaries of Ukraine and also the legal aid provision’ quality standards, developed for attorneys at law.
