КРИТЕРІЇ КЛАСИФІКАЦІЇ МІЖНАРОДНИХ ПРАВОВИХ СТАНДАРТІВ І МОЖЛИВІСТЬ ЇХ ЗАСТОСУВАННЯ ДЛЯ СИСТЕМАТИЗАЦІЇ МІЖНАРОДНИХ ПРАВОВИХ СТАНДАРТІВ ДОКАЗУВАННЯ

Abstract
The article is devoted to the research of the criteria for the classification of international legal standards in general and certain legal institutes, adjacent to criminal justice. Attention is drawn to the fact, that today in the doctrine of the criminal process the classification of international legal standards of proof was not carried out. In this connection, the necessity of the research of the classification criteria, determined by scientists, on the one hand, of the international legal standards as a whole, as well as separate legal phenomena, and, on the other hand, of the standards of proof, which are distinguished in the domestic criminal procedure, are grounded. The content of the criteria, proposed by the scientists for the classification of international legal standards, is revealed: 1) by the territory (space) of action (distribution); 2) by the degree of compulsory (deontical status); 3) by the subject of establishment; 4) by the circle of addressees; 5) by the degree of certainty of the content. Based on the analysis of theoretical concepts, it is possible to apply some of the following criteria for the systematization of international legal standards of proof. It is substantiated, that the following criteria are the basis for the classification of international legal standards of proof: 1) by the territory of action: the universal standards and the regional standards; 2) by the subject of establishment: the standards, that are formed in the activities of international organizations, and the standards, that are formed in the practice of international judicial institutions; 3) by the circle of addressees: the general standards, which applies to all subjects of criminal procedural proof, and the special standards, which concern to separate its subjects; 4) by the degree of certainty of the content: absolutely definite standards and relatively defined standards.
