LEGAL BASICS OF THE RELATIONS BETWEEN THE EU AND ITS MEMBER STATES: TO THE DISCUSSION OF THE FEDERAL NATURE OF THE UNION

Abstract
The article is dedicated to researching into the relations between the EU and its Member States with regard to the discussion of the federal nature of the Union. The article elaborates on the basics of legal regulation of entering, exiting and exiting the EU, as well as the exclusion from the Union; mutual obligations of the EU and Member States and basic principles of the distribution of competencies between the EU and its Member States. Major considered principles of the distribution of competencies between the EU and its Member States include: a principle of conferral of competencies, and principles of subsidiarity and proportionality. Comparisons with the legislation of federations are provided (Germany, Switzerland). The analysis of the problem, chosen for the investigation, allows singling out a considerable number of federal features of the EU.
