Legal description of the notion of distribution practice

Abstract
It is stated in the paper that the term distribution is being used for quite a long time in various scientific fields, e.g. engineering, philology etc. In law, at least in the national law, this term and others associated with it – distribution practice, distributor are used only in solitary isolated by-laws without any definitions. Most importantly, in the national juridical science there is no definition of distribution practice and description of procedures to carry it out legally. However, in economic operations distribution practice is widely used. Because of the absence of legal definition it is often substituted for similar notions such as supply and sales. But distribution practice is much wider than the ways of disposal of goods mentioned, it has many specific features and holds a separate place in the structure of economic and commercial activity. Though, first of all, the notion of distribution practice should be defined. In the present paper the most frequently used interpretations of the terms distribution, distribution practice, dealing and their correlations are examined. Based on this analysis it is concluded that dealing is mostly used to describe stock market sales. Finally, it is proposed to define distribution practice as a joint venture of economic agents, one of whom is a manufacturer that transfers goods to the possession of another economic agent with the aim and obligation to exclusively distribute goods on the regional markets
