LEGAL REGIME OF NATIONAL NATURAL PARKS AS A COMPONENT OF THE ECOLOGICAL NETWORK

Abstract

The article presents the study of the legal regime of national natural parks as a separate category of natural reserve fund. The analysis of normative and legal acts, which regulate the organizational and legal mechanism of activity of these protected territories, is carried out. The author investigates the legal status of national natural parks, the tasks they are entrusted with, and the peculiarities of the differentiated regime of their protection. Having made a detailed analysis of the legal regime and its components, the concept of the legal regime of national natural parks as a special order of legal regulation is defined. It is proposed to amend existing legislation on national parks and proposals for improving the legal protection of protected areas. National natural parks are nature protection, recreational, cultural and educational, scientific research institutions of national importance created for the purpose of preservation, reproduction and effective use of natural complexes and objects that have special environmental protection, recreation, historical and cultural, scientific, educational and aesthetic value. The diversified activity of national natural parks is ensured by a differentiated regime of protection and functional zoning, and it requires independent legal regulation. However, scientific studies did not pay enough attention to the analysis of the legal regime of national natural parks as objects of special protection; system analysis and substantiation of the peculiarities of legal regulation of the functioning of national natural parks are not presented; no proposals were made to improve the legislation on national natural parks, taking into account current trends in the field of biodiversity conservation, the latest international and European regulatory experience. It is precisely defined tasks that underlie preparation of this article, the general purpose of which is to analyze and study the legal regime of national natural parks.
