Abstract
The article is a comparative analysis of the provisions of Polish and Austrian law, with a due regard to regulation of the Council Directive 2001/23 / EC, in extent of liability of the transferor and the transferee for obligations arising from the a employment relationship, which arose before the date of transfer. Implementation of the Directive into Polish law took place in the art. 23 1 KC, and into Austrian law in §§ 3 - 6 AVRAG. The article focuses whether national Polish and Austrian regulations meet the objectives of the Directive, and whether its transposition into national agendas has resulted in identical regulations.
