LIMITATION OF COURT CARRIER’S LIABILITY FOR BREACH OF CONTRACT OF CARRIAGE OF GOODS BY ROAD

Abstract
The article analyzes the judicial practice of limitation of liability of a carrier under a contract of carriage of goods by road. It’s established that consolidation of limited liability of individual subjects of civil law in the Ukrainian civil legislation causes unjustified weakening of the regenerative function of civil liability, breach of the principle of equality and fairness. A limited scope of liability of a carrier under a contract of carriage of goods by road mean that the liability of carrier for certain violations of contract is established in the form of compensation of direct damage (or its part) or in exceptional penalty.
