মাক্বাসিদ আশ্-শারীয়াহ: পরিচিতি, ক্রমবিকাশ ও গুরুত্ব | Maqasid al-Shari'ah: Essence, Evolution and Significance

Abstract
Maqasid al-Shari‘ah refers to the collective dignified objectives that have been achieved by the rulings of the Shari‘ah. This paper endeavors to make a preliminary study on Maqasid al-Shari‘ah. By using analytical and descriptive methods the paper demonstrates the definition, essence, evolution and significance of Maqasid al-Shari‘ah. Maqasid al-Shari‘ah is considered an integral part of Shari‘ah (Islamic law). The comprehension of the provisions of Islamic law is subject to the realization of Maqasid al-Shari‘ah. Maqasid al-Shari‘ah have been discussed in the holy Qura‘n, Sunnah, the pronouncements of the Companions, as well as in the scripts of earlier Muslim scholars. Imam al-Juwayni [419-478 AH], al-Ghazali [450-505 AH], al-Shatibi [D 790 AH], ‘Izz ibn ‘Abd al-Salam [D 660 AH], etc. are some noteworthy scholars who inaugurated the discussion of Maqasid al-Shari‘ah. Al-Muwafaqat of al-Shatibi is considered the first book written on Maqasid al-Shari‘ah in particular. The prominent Muslim scholar Ibn Taymiyyah and his disciple Ibn Qayyim detailed further the principles of Maqasid al-Shari‘ah. The knowledge of Maqasid al-Shari‘ah is very instrumental in getting the shari (legal) solutions for the issues happen newly in the course of time. The command of Maqasid al-Shari‘ah is indispensable for mujtahid, mufti as well as for the researchers and learners of Islamic law. ইসলামী আইনের যাবতীয় বিধি-বিধানের মাধ্যমে যে সকল মহান লক্ষ্য-উদ্দেশ্যের বাস্তবায়ন নিশ্চিত করা হয়েছে তাই হচ্ছে মাক্বাসিদ আশ্-শারীয়াহ। মাক্বাসিদ আশ্-শারীয়াহ’র প্রাথমিক বিশ্লেষণ নিয়ে বর্তমান প্রবন্ধের অবতারণা করা হয়েছে। বিশ্লেষণ ও বর্ণনামূলক পদ্ধতিতে রচিত বক্ষ্যমাণ প্রবন্ধে মাক্বাসিদ আশ্-শারীয়াহ’র পরিচিতি, ক্রমবিকাশ এবং গুরুত্ব ও তাৎপর্য আলোচনা করা হয়েছে। ইসলামী আইন সংশ্লিষ্ট গুরুত্বপূর্ণ একটি বিষয় হচ্ছে মাক্বাসিদ আশ্-শারীয়াহ। মাক্বাসিদ আশ্-শারীয়াহ’র জ্ঞানের ওপর ইসলামী আইনের বোধগম্যতা, প্রজ্ঞা, চিন্তার গভীরতা এবং গবেষণার ব্যাপ্তি ইত্যাদি নির্ভর করে থাকে। কুরআন-হাদীসে, সাহাবীগণের বক্তব্যে এবং পরবর্তীতে পূর্বসূরী মুসলিম স্কলারদের লিখনীতে মাক্বাসিদ আশ্-শারীয়াহ’র আলোচনা পাওয়া যায়। মুসলিম স্কলারদের মধ্যে যারা সর্বপ্রথম মাক্বাসিদ আশ্-শারীয়াহ নিয়ে কথা বলেছেন তাদের মধ্যে আল-জুওয়াইনী [৪১৯-৪৭৮ হি.], আল-গাযালী [৪৫০-৫০৫ হি.], আশ-শাতিবী [মৃ. ৭৯০ হি.], আল-ইয্য ইবনে আবদুস সালাম [মৃ. ৬৬০ খি.] রহ. প্রমুখ উল্লেখযোগ্য। ইমাম আশ-শাতিবীর ‘আল-মুওয়াফাক্বাত’ শীর্ষক রচনা মাক্বাসিদ আশ্-শারীয়াহ’র ওপর সর্বপ্রথম স্বতন্ত্র গ্রন্থ হিসেবে বিবেচিত ও সুপরিচিত। যুগশ্রেষ্ঠ মুসলিম স্কলার ইবনে তাইমিয়াহ রহ. এবং তার সুযোগ্য শিষ্য ইবনুল কাইয়িম রহ. মাক্বাসিদ আশ্-শারীয়াহ’র আলোচনা ও বিশ্লেষণকে আরো প্রশস্ত ও বেগবান করেছেন। সময়ের আবর্তনে সংঘটিত বিভিন্ন সমস্যার সমাধান প্রদানের ক্ষেত্রে মাক্বাসিদ আশ্-শারীয়াহ’র জ্ঞান ও উপলব্ধি অত্যন্ত প্রয়োজনীয়। মুজতাহিদ এবং মুফতী থেকে শুরু করে ইসলামী আইনের ছাত্র, শিক্ষক ও গবেষকসহ সকলের জন্য মাক্বাসিদ আশ্-শারীয়াহ’র জ্ঞান অতীব গুরুত্বপূর্ণ।
