Abstract
The function of ethics, as a subject, is to assess the positive and negative behavior of an individual and judge the ‘dos’ and ‘don’ts’ based on morality. From the conventional viewpoint, only the voluntary actions of an individual are subjected to ethics. No forced action shall fall under it. It is verily conceivable that an individual shall be responsible for the action s/he has done at his own volition and he shall never be liable for the action he has been forced to do. Eventually there exists a clear distinction between ethics and law. In contrast, Islam teaches the morality which is integrated. In fact, the purport of Islam has been deeply rooted into the premise of moral teachings. The three apparatuses-adab (the principles of thought and behaviour), iÍsān (spiritual development) and akhlÉq (moral purification), play crucial role to determine the scope of ethics in Islam. Here law and ethics have been scientifically diluted. This article in adopting analytical and descriptive method provides the definition of ethics as found both in conventional and Islamic understandings and offers the mechanism of how this science has shaped the socio legal framework of Islamic legislation. শাস্ত্র হিসেবে নীতিবিজ্ঞানের কাজ হলো, একটি নৈতিক আদর্শ বা মানদণ্ডের আলোকে মানুষের আচরণের ভালো-মন্দ, উচিত-অনুচিতের বিচার করা। প্রচলিত ধারণায় মানুষের ঐচ্ছিক আচরণের ক্ষেত্রেই কেবলমাত্র নৈতিকতা বিচার্য, কোন বাধ্যতামূলক আচরণের ক্ষেত্রে নয়। কেননা, যে কাজ মানুষ তার নিজ ইচ্ছা বা মর্জিতে করে তার জন্য সে অবশ্যই দায়ী থাকে। কিন্তু যে কাজ তার নিজ ইচ্ছার বিরুদ্ধে করে বা করতে বাধ্য হয়, তার জন্য তাকে দায়ী করা যায় না। এ কারণে নৈতিকতা ও আইনের মধ্যে বিস্তর পার্থক্য তৈরি হয়। ইসলাম যে নৈতিকতা শিক্ষা দেয়, তা সমন্বিত। মূলত নৈতিক প্রস্তাবনার মধ্যেই ইসলামের মর্মবাণী নিহিত। ইসলামের আদব (চিন্তা ও আচরণের নীতিমালা), ইহসান (আধ্যাত্মিক উৎকর্ষ) এবং আখলাক (নৈতিক শুদ্ধতা) এ তিনটা গুরুত্বপূর্ণ পরিভাষা ইসলামী নীতিবিজ্ঞানের পরিধি নির্ধারণ করে। এ ব্যবস্থায় নৈতিকতা ও আইনের মধ্যে সমন্বয় করা হয়েছে অত্যন্ত বিজ্ঞানসম্মত পন্থায়। অত্র প্রবন্ধে বিশ্লেষণ ও পর্যালোচনা শৈলিতে প্রচলিত ও ইসলামী নীতিবিজ্ঞানের পরিচিতি, এ বিজ্ঞানে মুসলিম অন্বেষা এবং আইন ও নৈতিকতার সম্পর্ক বর্ণনা করা হয়েছে।
