NORMS OF PUBLIC MORALITY AS AN ADDITIONAL BASIS FOR CRIMINALLY-LEGAL QUALIFICATION

Abstract
The article explores the significance of moral and ethical norms in the process of criminal assessment of socially dangerous acts. There were defined the criminal provisions covering moral and ethical categories, the analysis of which is a necessary condition for a correct criminal evaluation of the acts and the complexities involved in such a case are brought out. It is stated that at the law-enforcement level, the limits of discretion (including judicial one) within the evaluation in the process of criminal assessment of moral and axiological concepts are correlated by the developed and generally arranged theoretical positions, as well as by the results of longstanding judicial interpretation of one or another norm.
