ON THE ADMINISTRATIVE-LEGAL MECHANISM OF INTERACTION BETWEEN EXPERT INSTITUTIONS AND LAW ENFORCEMENT BODIES

Abstract

The article explores the essence and structure of the administrative-legal mechanism of interaction of expert institutions with law enforcement bodies. On the basis of scientific opinions on the content of the terms “mechanism”, “legal mechanism” and “administrative and legal mechanism” it is determined that the administrative and legal mechanism of interaction of expert institutions with law enforcement bodies is a set of interrelated administrative and legal means, methods and forms, with the help of which the regulation of joint activities of expert institutions with law enforcement bodies is carried out. The scientific points of view on the structure of the administrative-legal mechanism are analyzed. The basic elements of the administrative-legal mechanism of interaction of expert institutions with law-enforcement bodies are determined: administrative-legal norms; administrative-legal relations; subjects possessing appropriate administrative powers; acts of law enforcement; means, methods and forms of influence on social relations; organizational elements of cooperation between expert institutions and law enforcement agencies. It is concluded that the administrative and legal mechanism of interaction of expert institutions with law enforcement bodies is a set of interrelated elements (tools) that provide joint activity of expert institutions with law enforcement agencies to perform their tasks. It defines all the principles of such activity, including its administrative and legal support, indicating that the investigated legal relations belong to the management and those provided by the state. All identified elements of the administrative and legal mechanism of interaction between expert institutions and law enforcement agencies are reflected in the relevant regulatory acts and correspond to the generally accepted principles of public administration.
