ON THE METHOD OF APPLYING FOR A PREVENTIVE MEASURE IN THE FORM OF DETENTION

Abstract
The article is devoted to the investigation of the method of preparation by the investigator, the public prosecutor of an application for applying a preventive measure in the form of detention, taking into account the requirements established by the criminal procedural law. It was determined that the observance by the investigator, the prosecutor of general rules, of the methodology for preparing an application for a preventive measure in the form of custody will ensure his legality, validity and motivation, compliance with the decisions and legal positions of the European Court of Human Rights. Attention is focused on the need to develop scientific and practical recommendations on the methodology for preparing an application for a preventive measure in the form of detention, taking into account the nature of pre-trial investigation of certain types of crimes and the specifics of criminal proceedings against certain categories of persons.
