ОСНОВНІ ЗАСАДИ РЕГУЛЮВАННЯ СІМЕЙНИХ ВІДНОСИН У США

Abstract
In the scientific article the main principles of regulation of family relations in the USA are researched. The principles contained in the legislation at the level of the whole federation, individual states, as well as in precedent cases are analyzed. Established that the regulation of family relations in the United States are within the competence of individual states, in this regard, there are a number of differences both in the legislation and in the judicial practice. In order to unify the laws of the states in the field of family relations, a number of legislative acts were developed, the special significance of which is the Marriage and Divorce Act (1970). The influence of liberal individualism on the legal regulation of family relations is established. At the level of US states, there is a different approach to the legal regulation of family relations, from their regulation to constitutional and legislative norms to predominantly case-law regulation. American scholars, when analyzing the fundamentals of family law, distinguish two key principles – biblical traditionalism and liberal individualism, which in their opinion characterize the contemporary American family law. In the United States there is legislative and case law governing both civil partnerships and same-sex marriages. Unusual for Ukrainian family law is the recognition in the United States of marital property intangibles, for example, the business reputation of a commercial firm. The cost of such assets can be estimated in cash equivalent and the share is paid accordingly to another spouse. Moreover, there are cases of “professional knowledge” in cases of detention. Taking into account the conducted research, conclusions were made on the need to improve the legal regulation of individual family institutions in Ukraine.
