PECULIARITIES OF TRANSPARENCY AND OPENNESS PRINCIPLES DURING CASSATION OF COURT DECISION IN CRIMINAL PROCEEDING IN UKRAINE

Abstract
The article is devoted to clarification of the transparency and openness principles implementation during the cassation appeal of court decisions in criminal proceedings, due to the peculiarities of the procedural form of cassation procedure organization in criminal proceedings. The significant feature of the cassation appeal of court decisions in the criminal justice system of Ukraine is outlined, which is to standardize the possibility of written cassation proceeding. Stand up for position that rule of the simplified cassation appeal procedure in criminal proceeding in the form of written cassation proceeding causes absentee cassation hearing, which contradicts the specifics of the control of this judicial review form and the correction of court errors. This fact led to a significant restriction of the implementation of the principles of transparency and openness of criminal proceedings in the court of cassation.
