ПИТАННЯ ПОВЕРНЕННЯ КУЛЬТУРНИХ ЦІННОСТЕЙ В СУЧАСНИХ УКРАЇНСЬКО-РОСІЙСЬКИХ ВІДНОСИНАХ

Abstract
У статті досліджено проблему повернення культурних цінностей, що з тих чи інших причин незаконно опинилися на території Російської Федерації чи України. У ній розкриваються головні аспекти цього питання, аналізується розвиток переговорного процесу, характеризується нормативно-правова база. Значна увага приділяється виокремленню причин, що заважали його швидкому вирішенню. У висновках дається оцінка стану справ у реституції культурних цінностей на сьогоднішній момент. In the article under analysis the problem of giving back the cultural values, which for one reason or another illegally appeared on the territory of the Russian Federation or Ukraine are investigated. The main aspects of the problem are revealed; the importance of its decision for the benefit of both countries is noted. This will help to improve the bilateral relations between Ukraine and the Russian Federation, preserve the world cultural heritage, and decrease the level of a political tension. Special attention is given to the features of negotiation process, its prolonging in time and the reasons of its coherence to the matter with such spheres of bilateral relationship as: political; legal; scientific and information; cultural; moral and ethical. All these required taking into consideration mentioned above aspects in order to get the solution. The impossibility of finding the solution of this question at the present stage is revealed, because of annexation of the Crimea and the war in the east of Ukraine, automatically caused new problems: illegal movement of cultural values in the territory of the Autonomous Republic of Crimea, returning of the expositions, from the museums of the Crimea which were exhibited at the other museums of the world. Special significance is attached to the analysis of standard and legal basis: to the characteristic of bilateral agreements; international acts; arrangements. Showing the internal political reactions to a certain international treaty or state law. In conclusion the ways of solution are provided: holding further negotiation process as the only legitimate way of returning the cultural values; formation on the territory of the Russian Federation museums of the Ukrainian culture and vice versa all these will promote public awareness and normalization of the bilateral relations
