PLACE OF TERRITORIAL COMMUNITIES IN THE PROTECTION OF THE RIGHTS, FREEDOMS AND LEGAL INTERESTS OF CITIZENS

Abstract

The article is devoted to the investigation of the issue of the territorial communities’ place when protecting the rights, freedoms and legal interests of citizens. It is established that territorial communities occupy a key role in the solution of these tasks. The author determined that by exercising their own powers, territorial communities through their own representative local governments interact with various law enforcement agencies. The realization of one's own powers in this matter occurs through the creation of an appropriate police financed by the local community and the creation of conditions for the functioning of civilian formations for the protection of public order and the state border. At the same time, local communities, contributing to the activities of civilian formations for the protection of public order, must start from their own financial capabilities to finance such activities and pay significant attention to legal educational work among the population. The development of an effective model of interaction between the police and society through local governments while ensuring human rights and freedoms must be flexible in the face of variability in the conditions for the existence of society, the functioning of the police and the aggressive external environment. However, in the relevant legislative acts or acts adopted in their development there is a need for a clearer statement of some of the wording. Another formation with which local governments should interact in the performance of the state's primary duty is the National Guard of Ukraine. The norms of the relevant legislation establishing such an order of interaction require their clarification and adjustment. The fulfillment by the territorial bulk of the state’s main duty should concern any citizen, without regard to his belonging or residence on the territory of a particular community.
