PROBLEMS OF INDIVIDUALIZATION OF PUNISHMENT FOR UNCOMPLETED CRIME

Abstract
The article examines state of legislative regulation and practice of application of Criminal Code that govern sentencing for uncompleted crime. The study allowed to conclude that disadvantages of regulation of specific rules for uncompleted crime make it impossible to exercise proper individualization of punishment, which is sentencing for person for such crime. These problems necessitate their solutions both through legislative changes and by certain adjustments in application of current legislation.
