PROVISION OF PUBLIC SERVICES AS CONSTITUTING ELEMENT OF THE CONSTRUCTION OF ARTICLE 365-2 OF THE CRIMINAL CODE OF UKRAINE

Abstract
The paper establishes that the list of special subjects, which is almost annually changed and supplemented by the legislator in the disposition of the main components of the crimes provided in Articles 345-2, 368-4, part 2 of Article 355 of the Criminal Code of Ukraine, indicates methodological defect of normative design, as it contradicts the principle of equality and legality, preventing the use of equal measure of state coercion against corrupt officials. This allows us to pay attention to the proposals for the establishment of a normative concept of public services as a main element of actus reus.
