REFUSAL OF THE PROSECUTOR TO SUPPORT THE STATE PROSECUTION IN COURT. HISTORICAL ASPECT

Abstract
In the article through the prism of the retrospective method of research, the main stages of the formation and development of the institute of the refusal of the prosecutor to support the state prosecution in court have been analyzed. The procedural procedure for the execution by the prosecutor of the obligation to refuse to support the state prosecution in court depending on the normative consolidation of the institute in different historical periods is outlined. In the course of the analysis, the main positive and negative features of the normative consolidation of the mentioned institute at the various stages of its formation were identified. The study made it possible to highlight the main achievements of the normative consolidation of the institution of the refusal of the prosecutor to maintain the state prosecution at the present stage and outline some of the gaps in its legislative consolidation.
