SCIENTIFIC-THEORETICAL UNDERSTANDING OF THE «FORECLOSURE ON THE DEBTOR’S PROPERTY» AS THE PROCEEDINGS OF THE EXECUTIVE PROCESS

Abstract
The article is devoted to the analysis of the essence of foreclosure on the debtor's property, in particular, the lack of a precise understanding of this concept at the legislative level, the definition of its specific components and conditions affecting their consistency. On the materials of the practice, foreclosure is considered as a way of protecting violated rights and as a procedural order for their recovery. Foreclosure is investigated as an independent proceedings of enforcement process, consisting of separate stages, united by a certain amount of actions of the executer.
