SLAUGHTER FREEDOM OF CONTRACT IN THE CONTEXT OF RULES WITH LACK OF WILL

Abstract
The article explores the legal nature of freedom of contract and abuse of freedom of contract in the context of transac- tions with shortcomings of will. The legal nature of freedom of contract as a subjective right, an element of legal capacity and a fundamental principle is disclosed, its definition, signs and boundaries are given. The phenomenon of abusing free- dom of contract is analyzed, and its main features are examined. His own definition of abuse of freedom of contract as a lack of freedom is given.
