Abstract
У статті здійснено аналіз наукових праць щодо вивчення питань виявлення та розслідування злочинів, пов’язаних з порушенням прав інтелектуальної власності з використанням мережі Інтернет. Розглянуто наукові дослідження за такими групами: 1) дослідження, присвячені проблемам протидії злочинам, пов’язаним з порушенням прав інтелектуальної власності; 2) дослідження, присвячені проблемам протидії злочинам у сфері використання комп’ютерної інформації та комп’ютерних мереж; 3) дослідження, присвячені проблемам протидії злочинам, пов’язаних з порушенням прав інтелектуальної власності з використанням мережі Інтернет. The article analyzes scientific works on the study of issues of detection and investigation of crimes connected with violation of intellectual property rights with the use of the Internet. Scientific researches on the following groups are considered: 1) researches on problems of counteraction to crimes connected with violation of intellectual property rights; 2) research on the problems of counteracting crimes in the sphere of the use of computer information and computer networks; 3) research on the problems of countering offenses connected with violation of intellectual property rights using the Internet. The analysis of scientific research on the problems of counteracting crimes related to violation of intellectual property rights leads to the following conclusion: within the framework of the theory of ORD and criminology, some issues of counteracting the crimes related to violation of intellectual property rights by their detection, documentation and investigation. At the same time, the overwhelming majority of analyzed jobs left the attention of the main system creating the factor - the use of the Internet in the process of committing such crimes. The presence of this factor significantly affects the process of detecting and investigating such crimes, and therefore there is an urgent need to study the organization and tactics of detecting and investigating such crimes. The analysis of works dedicated to the problems of combating crimes in the field of computer information and computer networks usage has shown that most of the authors in their work did not investigate the issue of counteracting crimes related to violation of intellectual property rights with the use of the Internet. A certain contribution to the study of the problems of counteraction to crimes related to violation of intellectual property rights through the use of the Internet was made by I.O. Voronov, who, at the level of his doctoral dissertation, investigated the problems of operative-detective counteraction to crimes in the sphere of high information technologies by the internal affairs bodies. The analysis of the group of scientific works on the problems of combating crimes related to the violation of intellectual property rights through the use of the Internet is not only a fact that today the study of problems of counteracting crimes related to the violation of intellectual property rights through the use of the Internet in operational searches activities and criminology are paid a lot of attention, however, such studies are not systemic and are presented only by a number of scientific articles. On the whole, the analysis of the above-mentioned works showed that in most modern scientific works the issue of detection and investigation of crimes connected with violation of intellectual property rights using the Internet is only partially covered, although it has important scientific and practical significance.
