СУЧАСНИЙ СТАН ПРОТИДІЇ ОПЕРАТИВНИМИ ПІДРОЗДІЛАМИ ОРГАНІЗОВАНІЙ ЗЛОЧИННОСТІ У СФЕРІ ЕКОНОМІКИ

Abstract
The article is devoted to the theoretical development of the problems of combating organized crime in the economic sphere by the operational units. The definition of the concept of organized criminal groups in the economic sphere is proposed and the characteristic of economic crimes committed by organized criminal groups is given. It has been determined that the transition to a market economy, the democratization of public administration, the change in forms of ownership, the decreasing of monitoring functions of the state, other economic and social processes are accompanied by the criminalization of spheres and branches of the economy, the growth of economic crimes committed by organized criminal groups. The organized groups, the criminal organizations that currently operate in the economy, differ from criminal groups in the early 1990s, since today they operate in all spheres of society’s life. Larger operational properties of organized criminal groups (hierarchy, advanced technologies, links of corruption, etc.) are determined. It is noted that organized groups, criminal organizations, criminal communities (as a rule, have transnational or interregional links) that can be considered as criminal groups (by mutual consent and awareness of two or more criminal organizations or a union of governing bodies or their leaders to coordinate actions on the organization and commission of grave and especially grave crimes for the purpose of tackling the proceeds of crime and their legalization). A definition of the notion of organized crime groups in the economic sphere, which refers to special social and criminal groups created (formed) in the structure of legal or shadow production, business, banking, credit and financial, foreign economic system, corrupt management bodies, other economic branches and spheres in order to receive on a regular basis criminal proceeds and their safe and effective legalization.
