The measures taken by states in the process of execution of the European Court of Human Rights’ judgments

Journal Title: Revista Institutului Național al Justiției - Year 2019, Vol 48, Issue 1

Abstract

As a result of the delivery of judgments finding violations by the European Court of Human Rights the concerned states, due to the binding force of these judicial acts, take the appropriate individual and general measures in order to implement the Court's conclusions. These two categories of measures are indispensable and imperative actions for the removal of the violation of the Convention for the Protection of Human Rights and Fundamental Freedoms, and for the prevention of new similar violations, attributed to the respondent state, which differ in the particularity of each and the nature of the produced impact.
