THE NEED FOR NORMALIZING THE PRINCIPLES OF INTERNATIONAL COOPERATION IN INQUIRIES INTO ACCIDENTS AT SEA

Abstract

The author presents international sources of forming the principles of international cooperation in proceedings concerning accidents at sea, especially the IMO resolutions. The concepts and rights of the flag, coastal and port states are discussed. The institution of consultation between states is indicated, and the concept of state which is or may be seriously interested in an accident at sea is defined. Attention is drawn to basic procedural requirements, and to limitations and exclusions of accessibility of another state to evidence. Finally, conclusions concerning future domestic legilation are presented.
