The offender’s identity in the system of empirical research on the prevention of real estate fraud in the residential sector

Abstract

The personal characteristics of a person of a selfish offender are outlined on the basis of investigation of cases of real estate fraud in the housing sector; Additional arguments are put forward in favor of using the concept of "criminal person" in criminological science. The concept of "man" includes the inextricable unity of the various aspects of its essence: social and biological. In the notion of "person" only specific social features, inherent in certain groups or communities, are recorded. A person is the social essence of a person, the one he has become in the process of socialization, his activities in society. Signs of a person can be not only positive, but also negative. The latter are characteristic of the person of the offender. Thus, the following typical features of the person of this offender are established: 1) in modern utility crime, in particular, real estate fraud in the residential area, young people (25-35 years old) are actively involved in the process, who have not found their place in life and have chosen criminal way of life; 2) there is a growing share of socially passive people whose representatives do not work, do not study and do not have a permanent source of income. The latter characteristic is attributed to criminologists to one of the major current crime-causing factors of crime; 3) there is a rather high level of education of criminals, which determines their behavior; 4) individual cases testify to organized or group methods of criminal activity, which includes persons authorized to perform functions of the state or local self-government bodies. Not least, all types of mass media contribute to nihilism in all its promises, including the rejection of daily routine work and the desire for easy profit with minimal cost of physical and intellectual efforts.
