THE PRINCIPLES OF INSTITUTIONAL SUPPORT FOR GOVERNANCE IN PUBLIC-PRIVATE PARTNERSHIP IN UKRAINE

Abstract

This article analyzes the current state of institutional environment of state administration in the field of public-private partner-ship. The analysis of the current legal framework of Ukraine, studied international experience of institutions in this area and are considered models of legal regimes. The analysis demonstrates the extremely low level of institutional capacity of government agen-cies and the private sector in the implementation of public-private partnership. Current condition characterized by low levels of in-terpersonal trust, public confidence in the public authorities, public and political organizations, aborted ideology partnership in so-ciety underestimation specialists of state and local government capacity projects in public-private partnerships, lack of public awareness of the benefits and risks of using the mechanisms public-private partnership, insufficient staffing of central government and local government experts in the field of public-private partnership, insufficient financing of the real economy. A when consider-ing the improvement of institutional support for governance in public-private partnership to pay attention to one side, namely civil society. It is necessary to build and develop a system of accountability to the public on the projects of public-private partnership because it is the end user community services (goods). The necessity to legislatively fix the duty of the state to provide management Familiarity society on costs, benefits and risks of projects in public-private partnerships in comparison to public procurement or pri-vatization. There should be a clearly defined institutional mechanisms for application of the Public Opinion Research projects on public-private partnerships. It was concluded that to improve the system of institutional support for governance in public-private partnerships should be considered a favorable institutional environment of partnership at all. Start must, above all, the creation of a special national body responsible for organizing and regulating the relations in the field of public-private partnership. With the ad-vent of such a body will be able to clearly define the powers of public authorities (communities and local authorities) involved in the preparation and implementation of public-private partnership at all stages of the central, regional and local levels. Offered at a Government of National Agency for public-private partnership. It is this submission will help resolve the issue of duplication of func-tions in the design and implementation of projects and create conditions for productive cooperation with line ministries and other central authorities. Urgent task of this institution is to develop efficient and assigned normative legal acts of the Cabinet of Ministers of Ukraine, the mechanism of coordination and interaction between central authorities in the implementation of projects of public-private partnership at the national level. At the stage of the creation of such agencies must be provided participation of civil society, scientists and experts in the work of the Agency. Such cooperation will ensure effective and socially oriented activities of the Agency during the preparation and implementation of public-private partnerships at the national and local levels. In this context one of the main tasks of the Agency is to develop mechanisms of cooperation with civil society towards the involvement of the community on a regular basis to discuss, assessment and monitoring of projects in public-private partnership. The necessity of improving the system of institutional support for governance in public-private partnerships at the local government level, strengthening their functions. Normative and legal basis for cooperation between the Agency and local authorities should provide for the right of local authorities within their powers and applicable law to make decisions about the feasibility of projects in public-private partnership.
