ENFORCEMENT PROCEEDINGS AS A MEANS OF COERCION: PROBLEMS AND WAYS TO IMPROVE

Abstract
This article deals with problems of enforcement proceedings as a factor in the formation of national consciousness in the direc-tion of the need and obligation of execution of decisions of courts and other branches of power. The relevance of the chosen theme is that the current system of state executive service agencies and law regulated the execution process is not able to ensure the proper execution of decisions of courts and other bodies in order to restore the violated rights of citizens and legal persons, disappearing confidence in the state and public bodies that the thus creating a negative image. With this in mind, the reforms are the only way to improve the situation, and without them, the further the activities of the state executive ser-vice is not efficient. The aim of the study is to define the basic principles of the enforcement proceedings, the order of formation of procedural docu-ments of enforcement proceedings, generalization of the practice of the organs of state executive service performance and identify deficiencies in the implementation process of the executive production and the formation of the system of execution. The author analyzes the current state of development of the enforcement proceedings in Ukraine, reforming the bodies that carry out the execution process. It examines the concept of the executive production bodies and officials - state performers, who are en-trusted with the duty of the enforcement proceedings and others. Also in this article the interpretation of the role of the state executive service in the modern state building. Certain steps in the reform of the state executive service has already been done, put into effect a state enterprise Away, which carried out the implementation of the arrested property of debtors, public performers have access to the registry of real estate rights in some regions introduced pilot projects with new software enforcement process.
