The problems of balancing the interests of society, authors and other rightholders during creating and using a product of cinematography as a multiplex complex object of intellectual property law

Abstract
Based on the analysis of the works of Ukrainian and foreign scientist, the current legislation of Ukraine, EU Legislation, draft of legislative initiatives, the article reveals the problems of ensuring the balance of interests of the society, authors and other rightholders while creating and using the products of cinematography. The emphasize is made on the definition of balance of interests, on the concept of public interest in the context of the term of copyright protection for products of cinematography, changes in the protection of copyright in the Internet in EU, and the activities of collective management organization, the need to consolidate the “freedom of panorama”, Creative Commons licences. The attention is paid to the balance of interests of authors and rightholders in terms of the principles of coexistence of these interests, and in the context of reviewing the author’s composition of cinematographic products.
