THE THEORETICALLY-LEGAL ASPECTS OF APPLICATION OF THE LEGAL DOCTRINE AS THE AUXILIARY SOURCE OF LAW IN UKRAINE

Abstract
The article is devoted to the analysis of problem of application of the legal doctrine as an additional source of law of modern Ukraine. It is noted that the legal doctrine is the prerequisite for creation of legal rules, and also, provides law-making process with conceptual framework and methodological tools for identification of public needs in legal regulation of public relations and formation of legal designs and rules. In general, the legal doctrine expresses the existing legal reality.
