Abstract
The article is devoted to the study of the theoretical and legal phenomenon of the bankruptcy institute in the domestic legislation in the context of issues of creditor initiation. The necessity of eliminating existing gaps in legislation in the field of bankruptcy is substantiated. It is proved the importance of legal consolidation of the concept of “initiating creditor” and the normative settlement of the uncertainty of requirements in the part of financial sanctions.
