Abstract
This paper addresses the consequences of filling an action to set aside an arbitral award to the court which lacks jurisdiction in terms of compliance with the time limit set under thePolish Code of Civil Procedure. The authors extensively recalled thesis presented in the jurisprudence of Polish courts as well as in the legal doctrine. The evolution of opinions is also shown. Finally, the article finds the answer to how this legal issue should be solved by courts. It also indicates that the legislator’s intervention is needed to regulate post-arbitral proceedings more comprehensively.
